These Terms of Service ("Terms") are an agreement between NDS STUDIO LLP, H33, IT Park, Udaipur, Rajasthan 313001, India ("we", "us"), and the business or person using LeadSmart at https://leadsmart.pro (the "Service") ("you"). By creating an account or using the Service, you agree to these Terms.

1. The Service

LeadSmart captures leads from Meta (Facebook/Instagram) lead ads into a dashboard, syncs them to Google Sheets, sends WhatsApp alerts to your business, forwards leads to webhooks you set up (so follow-ups can be automated through integrations such as n8n), and sends Meta Pixel / Conversions API event signals you configure.

2. Eligibility and accounts

You must be at least 18 and able to enter a binding contract. Keep your login details secure; you are responsible for activity on your account.

3. Free trial

New accounts get a 14-day free trial. No credit card is needed. If you do not subscribe when the trial ends, access to paid features stops. Your trial data is kept for 30 days after the trial ends, so you can subscribe and continue; after that it may be deleted.

4. Plans, pricing and billing

  • Pro monthly: ₹1,499/month regular price; currently offered at ₹499/month.
  • Pro yearly: ₹14,999/year regular price; currently offered at ₹4,999/year.

Prices include GST. Subscriptions renew automatically for the same period until cancelled. Renewal pricing may change; we will give at least 7 days’ notice by email before a change applies. If you subscribe at the ₹499/month offer price, you are charged ₹499/month for the first 12 months from signup; after that, renewals move to the regular price of ₹1,499/month. If you subscribe to the yearly plan at the ₹4,999 offer price, renewals after the first year move to the regular price of ₹14,999/year. We will email you at least 7 days before your first renewal at the regular price.

5. Third-party services and fees

The Service connects to Meta, Google and other services you choose. Your use of them is governed by their terms. WhatsApp Business API messaging runs on your own Meta API keys, and you pay any Meta/WhatsApp fees directly to Meta; these are not included in LeadSmart pricing. We are not responsible for outages, policy changes or account actions by those providers.

6. Your data and responsibilities

You own the lead data you bring into the Service. You are responsible for having a lawful basis to collect and use it, including giving Leads the notices and getting the consents required by the DPDP Act and Meta's policies. You allow us to process this data only to provide the Service, as described in our Privacy Policy.

7. Acceptable use

You must not:

  • break any law or Meta, Google or WhatsApp policy;
  • send spam or unsolicited messages;
  • upload malware or try to breach the Service's security;
  • resell or reverse-engineer the Service without our written consent.

We may suspend accounts that break these rules.

8. Intellectual property

We own the Service, the LeadSmart name and all related software and content. We give you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

9. Availability and changes

We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may improve, change or discontinue features; we will give reasonable notice of material changes.

10. Cancellation and termination

You may cancel at any time, as set out in our Refund & Cancellation Policy. We may suspend or terminate accounts for breach of these Terms or non-payment. After termination, you can request an export of your data within 30 days, after which it may be deleted.

11. Disclaimers

The Service is provided "as is". We do not guarantee any specific number of leads, conversions or advertising results.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, including lost profits or data, and our total liability is limited to the fees you paid us in the 12 months before the claim.

13. Indemnity

You agree to compensate us for claims arising from your misuse of the Service, your lead data or your breach of these Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Courts in Udaipur, Rajasthan have exclusive jurisdiction.

15. Changes to these Terms

We may update these Terms. We will post the new version here and email you about significant changes. Continuing to use the Service means you accept them.
